1. Agreement

By using the website or services of Wescott Marketing, you agree to these terms.

2. Services

Wescott Marketing provides marketing services including website design, messaging automation, review collection, and marketing campaigns for a monthly subscription of $297/month.

3. SMS Terms & Conditions

Program description: Wescott Marketing sends conversational and informational text messages, including replies to inquiries, appointment and service updates, and — only for customers who have opted in — occasional marketing messages.

Consent: By providing your phone number through our website form, by texting us first, or by calling us, you consent to receive text messages from Wescott Marketing. Consent is not a condition of purchase.

Message frequency: Message frequency varies based on your interaction with us.

Fees: Message and data rates may apply depending on your mobile carrier plan.

Opt-out: You can opt out at any time by replying STOP to any message. You will receive a confirmation message, and no further messages will be sent unless you opt back in.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

4. Payment terms

Services are billed at $297/month on a month-to-month basis with no long-term contract. The standard setup fee is $500. Wescott Marketing is currently waiving the setup fee for new clients; any change to this promotion will not affect existing clients. You may cancel anytime with written notice before the next billing cycle. Service will continue through the end of your current paid period, and no refunds are issued for partial months.

5. Client responsibilities

You must provide accurate business information and content. When using our messaging features to contact your own customers, you must obtain proper consent from them in accordance with applicable laws.

6. Intellectual property

Website content and materials provided by us belong to Wescott Marketing or its licensors. You retain ownership of your own business content and data.

7. No guarantees disclaimer

Services are provided "as is". Wescott Marketing does not guarantee specific business results, revenue, lead volume, or search engine rankings.

8. Limitation of liability

Our liability is limited to the fees paid by you in the prior 12 months. We are not liable for indirect or consequential damages.

9. Termination

Either party may cancel per the payment terms. Wescott Marketing may suspend service for non-payment or misuse of the platform.

10. Governing law

These terms are governed by the laws of the State of South Carolina.

11. Changes to terms

Updates to these terms will be posted on this page. Continued use of our services constitutes acceptance of the new terms.
